1. Acceptance of Terms

Welcome to TapToPark.

These Terms of Service (“Terms”) govern your access to and use of the TapToPark mobile application, website, SMS services, and related products and services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Services.

2. About TapToPark

TapToPark provides technology and software solutions that facilitate communication and operational workflows between drivers and participating valet operators.

TapToPark is not a valet parking company and does not provide valet parking services.

Valet services are provided solely by independent participating operators.

3. User Accounts

You may be required to create an account to access certain features.

You agree to:

  • Provide accurate information
  • Maintain current account information
  • Protect your login credentials
  • Notify us of unauthorized account access

You are responsible for all activity occurring under your account.

4. Valet Services

TapToPark does not:

  • Park vehicles
  • Store vehicles
  • Operate valet services
  • Employ valet attendants
  • Control participating operators

The valet operator is solely responsible for:

  • Vehicle handling
  • Vehicle storage
  • Employee conduct
  • Customer interactions
  • Damage claims
  • Operational procedures

Any dispute regarding valet services should first be directed to the participating operator.

5. Vehicle Photographs

Participating operators may capture photographs of vehicles during check-in.

Vehicle photographs may be used for:

  • Documentation of vehicle condition
  • Operational records
  • Customer service
  • Investigation of claims

Photo availability and retention periods may vary.

TapToPark does not guarantee permanent storage of photographs.

Users are encouraged to download and retain any photographs they wish to keep.

6. Payments

Payments may be processed through third-party payment processors.

By submitting payment information, you authorize the applicable payment processor to charge the selected payment method.

TapToPark does not guarantee the availability of any payment processor and is not responsible for processor outages, delays, chargebacks, banking issues, or payment disputes.

7. Vehicle Retrieval Requests

The TapToPark platform may allow users to submit vehicle retrieval requests.

Submission of a retrieval request does not guarantee immediate vehicle availability.

Actual retrieval times depend on the participating operator’s staffing, operational conditions, traffic, weather, and other circumstances.

8. Prohibited Use

You agree not to:

  • Use the Services unlawfully
  • Attempt unauthorized access
  • Interfere with platform operations
  • Submit false information
  • Circumvent security measures
  • Use automated scraping tools
  • Impersonate another person or entity

9. Intellectual Property

The TapToPark platform, software, trademarks, branding, designs, workflows, and content are owned by TapToPark LLC and protected by applicable intellectual property laws.

No ownership rights are transferred to users.

10. Third-Party Services

The Services may integrate with third-party providers, including:

  • Payment processors
  • SMS providers
  • Mapping services
  • Cloud hosting providers
  • Analytics providers

TapToPark is not responsible for the services, policies, or availability of third-party providers.

11. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

TapToPark makes no warranties regarding:

  • Availability
  • Accuracy
  • Reliability
  • Uninterrupted operation
  • Error-free functionality

To the fullest extent permitted by law, all warranties are disclaimed.

12. Limitation of Liability

To the fullest extent permitted by law, TapToPark shall not be liable for:

  • Vehicle damage
  • Vehicle theft
  • Personal injury
  • Property loss
  • Operator misconduct
  • Payment processor failures
  • Lost profits
  • Indirect or consequential damages

TapToPark’s total liability arising from use of the Services shall not exceed one hundred dollars ($100) or the amount paid directly to TapToPark by the user during the preceding twelve months, whichever is greater.

13. Indemnification

You agree to defend, indemnify, and hold harmless TapToPark, its officers, employees, contractors, and affiliates from claims arising from:

  • Your use of the Services
  • Violation of these Terms
  • Violation of applicable laws
  • Misuse of the platform

14. Termination

TapToPark may suspend or terminate access to the Services at any time for:

  • Violations of these Terms
  • Security concerns
  • Fraudulent activity
  • Operational reasons

Users may discontinue use of the Services at any time.

15. Changes to Services

TapToPark may modify, suspend, or discontinue any feature or portion of the Services without prior notice.

16. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Florida.

17. Changes to These Terms

TapToPark may update these Terms periodically.

Updated versions will be posted within the Services.

Continued use of the Services constitutes acceptance of the revised Terms.
